Terms of Use

These Terms of Use govern your use of Real Torch, including Atlas, our CRM tools, shared brief links, websites, and related services (collectively, the "Services"). By using the Services, you agree to these Terms.

Our Privacy Policy explains how we collect and use personal information. Although it does not form part of these Terms, it is an important document that you should read.

1. Who may use the Services

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services for a business or professional purpose. If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

2. Registration and access

You must provide accurate and complete information when creating or using an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

You must promptly notify us if you believe your account has been compromised or used without authorization.

3. Using the Services

You may use the Services only in compliance with these Terms and applicable law.

What you may do

  • Access and use the Services for lawful business purposes.
  • Create reports, briefs, analyses, and other work product using the Services.
  • Subject to these Terms and applicable law, use, publish, distribute, and sell the research and deliverables you create with the Services.

What you may not do

  • Use the Services in a way that violates law, infringes rights, or breaches contractual obligations.
  • Upload or submit content that you do not have the right to use.
  • Interfere with, disrupt, probe, bypass, or defeat security, authentication, rate limits, or other protective measures.
  • Scrape, crawl, benchmark at scale, or programmatically extract the Services or outputs in a way that harms the Services or exceeds authorized use.
  • Attempt to reverse engineer, decompile, reconstruct, extract, or discover the source code, hidden prompts, system prompts, model behavior, underlying components, or proprietary workflows of the Services.
  • Use prompt injection, jailbreak attempts, adversarial testing, or similar tactics to circumvent safeguards or reveal confidential system behavior without our written authorization.
  • Use the Services or outputs to build, train, validate, or improve a competing model or service in a way that copies or substitutes for Real Torch’s platform.
  • Represent AI-generated output as human-generated where doing so would be misleading.
  • Transmit malware, harmful code, or content intended to compromise the Services or other users.

Shared links and public content

Some features allow you to publish or share content by link. If you choose to do so, you are responsible for that decision and for ensuring that the shared content is appropriate to disclose.

Third-party services

The Services may rely on third-party software, infrastructure, authentication providers, model providers, or payment processors. Those third-party services may be subject to their own terms and policies.

4. Content

You may provide input to the Services, including prompts, files, documents, CRM records, and other materials ("Input"), and receive output generated by the Services ("Output"). Input and Output together are "Content."

Your Content

As between you and Real Torch, you retain ownership of your Input. Subject to applicable law and any third-party rights, you own your Output.

You are responsible for Content, including for ensuring that it does not violate law, these Terms, or the rights of others, and for confirming that you have all rights, licenses, and permissions necessary to provide Input to the Services.

Your license to us

You grant Real Torch a limited, non-exclusive license to host, store, copy, process, transmit, and use Content as necessary to provide, operate, secure, support, and improve the Services, comply with law, and enforce our terms and policies.

Similarity of output

Because artificial intelligence systems may generate similar responses for different users, Output may not be unique and other users may receive similar output.

Accuracy and review

AI-generated output may be incomplete, inaccurate, or out of date. You must evaluate Output for accuracy and appropriateness for your use case before using or sharing it. Do not rely on Output as a sole source of truth or as a substitute for professional judgment or advice.

Real Torch clients may use and sell the research they create with the Services, but that permission does not transfer ownership of the Real Torch software, prompts, models, workflows, or platform technology.

Feedback

If you provide feedback, suggestions, or ideas about the Services, we may use them without restriction or obligation to you.

5. Our IP rights

Real Torch and its licensors own all rights, title, and interest in and to the Services, including our software, interfaces, workflows, prompts, branding, and related technology, except for rights expressly granted to you in these Terms.

Paid subscriptions, pilots, and service packages may be subject to separate pricing, order forms, invoices, or commercial agreements. Unless otherwise agreed in writing, fees are non-refundable except where required by law.

If a third-party payment processor is used, your payment relationship with that processor is governed by its terms in addition to these Terms.

7. Termination and suspension

You may stop using the Services at any time.

We may suspend or terminate your access if we reasonably determine that:

  • You breached these Terms or our policies.
  • We must do so to comply with law.
  • Your use creates risk, security concerns, fraud concerns, or harm to Real Torch, the Services, other users, or third parties.
  • Required fees remain unpaid.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, REAL TORCH DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REAL TORCH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATING TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REAL TORCH’S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO REAL TORCH FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the effective date above. Continued use of the Services after updated Terms take effect means you accept them.
